Welcome to JustMyType.me ("Service"), operated by FINEXMA, Inc. ("Company," "we," "us," or "our"). By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Service Overview

JustMyType provides an AI-assisted personality discovery experience, including chat-based interactions, personality insights, archetype classifications, and subscription features. The Service is designed for entertainment, self-reflection, and informational purposes only.

2. Important Disclaimers

2.1 Not Professional Advice

The Service is for entertainment and self-reflection purposes only. JustMyType is not a medical, psychological, psychiatric, or professional counseling service. The personality insights, archetype classifications, type assessments, and AI-generated content provided through the Service:

Do not constitute a diagnosis of any kind
Are not a substitute for professional mental health advice, diagnosis, or treatment
Should not be used to make important life decisions
Are not scientifically validated personality assessments
Should not replace consultation with qualified professionals

If you have concerns about your mental health or well-being, please consult a licensed healthcare provider or mental health professional.

2.2 AI Output Disclaimer

The Service uses artificial intelligence to generate personality insights and content. AI-generated outputs may be inaccurate, incomplete, or inappropriate. We make no guarantees regarding the accuracy, reliability, or suitability of any AI-generated content. You acknowledge that:

AI outputs are generated algorithmically and may contain errors
Results may vary and are not guaranteed to be consistent or reproducible
The AI does not "know" you and cannot make definitive statements about your personality
You should not rely solely on AI-generated content for any purpose

2.3 Original Content and Non-Affiliation

The personality frameworks, house systems, archetypes, and classifications used in JustMyType are original creations of FINEXMA, Inc. Our content, including but not limited to house names, descriptions, imagery, and personality categorizations:

Is not affiliated with, endorsed by, or derived from any existing fictional works, media franchises, or entertainment properties
Is not affiliated with, endorsed by, or derived from any existing personality assessment systems, frameworks, or methodologies
Any perceived similarity to existing intellectual property, fictional works, or personality systems is coincidental and unintentional

References to common personality typing terminology are used for informational and comparative purposes only and do not imply any official certification, endorsement, or affiliation with the creators, owners, or trademark holders of any existing systems or frameworks.

3. Eligibility

3.1 General Age Requirement

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

3.2 Paid Subscriptions

Paid subscriptions require users to be at least 18 years of age. By purchasing a subscription, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

Parent/Guardian Option: If you are under 18 and wish to access paid features, a parent or legal guardian may create and manage the account on your behalf. In this case, the parent or guardian is the legal account holder and is responsible for all activity on the account.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activity that occurs under your account.
You must provide accurate information and comply with all applicable laws.
You agree to notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful, harmful, harassing, defamatory, or abusive purpose
Attempt to reverse engineer, decompile, or disassemble any part of the Service
Gain unauthorized access to our systems, networks, or data
Use automated tools to scrape, crawl, or extract data from the Service
Circumvent rate limits, authentication mechanisms, or access controls
Impersonate any person or entity or misrepresent your affiliation
Upload or transmit malicious code, viruses, or harmful content
Interfere with or disrupt the Service or servers/networks connected to it

6. Subscriptions and Billing

You must be 18 years of age or older to purchase a subscription.
Paid subscription plans are billed through Stripe. Pricing and billing terms are displayed at checkout.
Subscriptions automatically renew at the end of each billing period unless canceled.
You may cancel your subscription at any time through the Billing Portal in Settings.
Upon cancellation, you retain access to paid features until the end of your current billing period.
We reserve the right to modify pricing with reasonable notice to existing subscribers.
Parents or guardians may purchase subscriptions for minors (ages 13-17) by creating and managing the account themselves.

7. Refunds

We may offer a discretionary refund within 30 days of your first purchase if you are not satisfied with the Service. Refund requests are evaluated on a case-by-case basis. To request a refund, contact us at hello@justmytype.me.

8. Intellectual Property

All content, trademarks, logos, service marks, trade names, and other intellectual property displayed on or through the Service are owned by FINEXMA, Inc. or its licensors. You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, lease, or create derivative works based on our content or intellectual property without our prior written consent.

9. User Content

By submitting content through the Service (including chat messages and responses), you grant us a non-exclusive, worldwide, royalty-free license to use, process, and analyze such content to provide and improve the Service. We may use aggregated, anonymized data for research and product development purposes.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FINEXMA, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless FINEXMA, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise inappropriate. Upon termination, your right to use the Service will immediately cease.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Delaware, and judgment on the arbitration award may be entered in any court having jurisdiction.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against FINEXMA, Inc.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FINEXMA, Inc. regarding the Service and supersede all prior agreements and understandings.
